Assault Defense Lawyer

An assault occurs when a person intentionally, or recklessly, causes physical injury to another person's body. There are different types of assault charges that exist in the state of Alabama. Some of them are classified as felonies. Some of the charges are misdemeanors. There is a big difference between a misdemeanor and a felony charge.

Each type of assault charge has its own very specific rules and guidelines for sentencing. Throughout our firms times as assault attorneys, we have had all types of assault cases dismissed or have had charges reduced. These charges include:

  • First degree assault
  • Second degree assault
  • Third degree assault

A charge of assault in the third degree includes assault that is intended to cause harm to someone, sometimes with the use of a deadly weapon. If you are convicted you face a sentence of no more than 1 year of jail time and a fine of up to $6,000.

Charges of assault in the second degree could include assault that is intended to cause harm to a police officer or a health care worker, sometimes with the use of a deadly weapon. If you are convicted you face a sentence of 1 to 10 years of jail time and a fine of up to $15,000.
